SnapBlog Terms and Conditions

Important Notice: This document establishes the legal terms governing access and use of the SnapBlog platform ("Platform" or "Service"). By creating an account, browsing or using any functionality of the Platform, you ("User" or "Customer") declare that you have read, understood and fully agreed to these Terms and Conditions, our Privacy Policy and, when applicable, the Data Processing Agreement (DPA). If you disagree with any provision, immediately stop using.

1. Definitions

  • SnapBlog – SaaS blog automation platform that uses artificial intelligence (AI) to create, edit and publish content on a Customer's website blog, being able to connect to the Customer's Instagram account to import data or function in manual mode.
  • User Content – Data, images, texts, audios, videos, metadata, hashtags and other information provided, imported or generated by the User on the Platform.
  • AI Generated Content – Result produced by SnapBlog's AI models from User Content or instructions provided by the User.
  • Plans – Subscription modalities (Basic, Pro, Enterprise) with different features, storage limits ("Storage") and prices.
  • Overage – Usage in excess of Plan limits.
  • GDPR – General Data Protection Regulation (EU) 2016/679.
  • Instagram API – Programmatic interfaces made available for integrating third-party applications with Instagram.

2. Eligibility

To use the Platform, the User must:

  • Be at least 18 (eighteen) years old or legal age in your jurisdiction;
  • Have full civil capacity to enter into contracts;
  • Provide truthful and complete information during registration;
  • Accept these Terms and the Privacy Policy.

3. Service Description

SnapBlog offers:

  • Content Automation – Generation of blog articles from linked Instagram Business/Creator posts or from manual prompts;
  • Advanced Editor – Text adjustment, translation, assisted SEO and publication scheduling;
  • Media Hosting – Storage of images, videos and blog-related files according to the Plan;
  • Dashboards – Performance metrics, publication history and Storage usage;
  • API – (for Business/Enterprise Plans) third-party integration;
  • Support – Service channels according to Plan SLA.

4. Instagram Integration and User Obligations

  • Consent – To activate the automatic functionality, the User must connect their Instagram Business or Creator account via OAuth and grant the requested permissions.
  • Meta Compliance – The User undertakes to comply with the Meta for Developers Platform Policies and Instagram API Terms of Use. Non-compliance may result in immediate suspension of access to functionality.
  • Access Revocation – The User may, at any time, disconnect their Instagram account in the settings. Revocation does not affect the legality of processing performed before revocation.
  • Independence – SnapBlog is not affiliated, sponsored or endorsed by Instagram or Meta Platforms, Inc.

5. Registration, Account Access and Security

  • Each account is individual and non-transferable. The User must keep their credentials confidential.
  • The User is responsible for activities performed under their credentials.
  • Suspected unauthorized use should be reported immediately to SnapBlog.

6. Plans, Prices, Billing and Taxes

  • Subscription – Plans are offered on monthly or annual renewal, with advance payment via credit card, bank slip or PIX.
  • Plan Change – The User can migrate Plans at any time, subject to proportional billing.
  • Overage – If Storage usage or article generation exceeds the Plan limit, Overage rates will be applied according to the current table, billed in the following cycle.
  • Price Adjustment – SnapBlog may adjust prices with 30 (thirty) days advance notice.
  • Right of Withdrawal – Users residing in eligible jurisdictions may cancel the subscription within 7 (seven) calendar days after contracting, with full refund.
  • Taxes – Displayed prices include applicable federal and state taxes, unless otherwise indicated.

7. License of Use and Intellectual Property

  • Platform License – SnapBlog grants the User a limited, non-exclusive, non-transferable and revocable license to access and use the Service during the Plan validity.
  • User Content – The User retains all rights to User Content. By submitting it, grants SnapBlog a worldwide, free and sublicensable license to host, process and display the Content exclusively for the purpose of providing the Service.
  • AI Generated Content – Except when otherwise specified, the User owns the rights to AI Generated Content in accordance with applicable laws, being responsible for reviewing, validating and ensuring that its use does not violate third party rights.
  • Trademarks – SnapBlog and its logos are registered trademarks. Their use is prohibited without prior authorization.

8. AI Generated Content – Warnings and Limitations

  • Variable Results – AI Generated Content may contain factual inaccuracies, opinions or biases. Human review is recommended before publication.
  • Responsibility – The User is solely responsible for verifying the veracity and legal compliance (including copyright, advertising and privacy) of AI Generated Content.
  • Model Training – User data is not used to re-train public AI models without express consent.
  • Disclaimer of Warranties – SnapBlog does not guarantee that AI Generated Content will be original, free from third party claims or suitable for any specific purpose.

9. Usage Limits, Storage and Overage

  • Each Plan includes Storage limits (GB), number of articles per month and simultaneous integrations.
  • Once limits are exceeded, the User may choose to:
    • Reduce usage to within the limit within 72 hours; or
    • Accept Overage rates or migrate to higher Plan.
  • Failure to adjust or pay Overage may result in partial suspension of Service.

10. Acceptable Use and Prohibited Conduct

It is prohibited to:

  • Violate laws, regulations or third party rights;
  • Publish or generate illegal, defamatory, obscene, violent content or that promotes hate speech;
  • Attempt to reverse engineer, decompile or hack the Platform;
  • Use the Platform for spamming, phishing or unauthorized scraping purposes;
  • Submit sensitive personal data of third parties without legal basis.

11. Privacy and Data Protection (GDPR)

  • We treat personal data in accordance with GDPR and applicable local laws.
  • Data subject rights: confirmation of processing, access, correction, anonymization, portability, deletion and opposition.

  • International transfers follow adequate safeguards (Standard Contractual Clauses or similar).

12. Confidentiality

Both parties agree to keep confidential technical, commercial and strategic information received and not make it public without consent, except when required by law.

13. Security

We adopt administrative, technical and physical security practices to protect data, including encryption in transit (TLS 1.2+), daily backups and 24×7 monitoring. No system, however, is 100% secure.

14. Limited Warranties

The Service is provided "as is". We do not guarantee that it:

  • is free from errors or interruptions;
  • meets specific needs;
  • AI Generated Content is accurate or reliable.

15. Limitation of Liability

To the maximum extent permitted by law, SnapBlog's total liability for direct damages will be limited to the amount actually paid by the User in the 12 (twelve) months prior to the event. SnapBlog is not responsible for lost profits, indirect, special, punitive or consequential damages.

16. Indemnification

The User agrees to indemnify and hold harmless SnapBlog, its controllers, directors and employees from any claims or expenses arising from use of the Platform in violation of these Terms.

17. Suspension and Termination

We may suspend or cancel the account:

  • for material violation of these Terms;
  • by court orders or authorities;
  • for default exceeding 15 days;
  • if use jeopardizes Platform security.

In case of termination, the User may download their Content in standard format for up to 30 days.

18. Changes to Terms or Service

We may change these Terms or Platform features with advance notice of at least 30 days. Continued use after the changes take effect implies acceptance.

19. Subscription and Auto-Renewal Provisions

Auto-renewal is previously informed and can be canceled at any time through the same contracting channel. A renewal notice will be sent at least 7 days before expiration.

20. Applicable Law and Jurisdiction

These Terms are governed by the laws of the jurisdiction where the User is located. The competent court will be determined according to local laws.
